When you sign up to become a Teacher (“Teacher”) with GiveThx you will be asked to provide us with certain Personal Information, such as your name, email address, password, and the school where you work (“Personal Information”). Alternatively (and recommended), Teachers can sign up with a Google’s third-party login. Please see below for relevant information collected. We may also obtain information from your school, should they choose to create a school account with GiveThx, and combine that with information we collect directly from you.
When you register for a Student (“Student”) Account, you will be asked to provide us with certain Personal Information, such as your name, email address, and password. Alternatively (and recommended), Students can sign up with Google’s third-party login. Please see below for relevant information collected.
We collect Usage Information (“Usage Information”) from Users who use our Service. For example, we store the Thx Notes and Reflections created in GiveThx. Our Service also stores information about Users regarding their giving frequency, giving goal progress, and the distribution of reasons they are thankful to others and others are thankful to them (“Statistics”).
Like most websites, we use Google Analytics services to monitor Site usage. The data we collect is anonymous and helps us build better tools based on usage patterns. To ‘opt out’ of data collection, visit the Google Analytics opt-out page.
We may disclose your Personal Information and Usage Information to government authorities, and to other third parties when compelled to do so by government authorities, at our discretion, or otherwise as required by law, including but not limited to in response to court orders and subpoenas. We also may disclose your Personal Information and Usage Information when we have reason to believe that someone is or may be causing injury to or interference with our rights or property, other users of this Site, or anyone else that could be harmed by such activities.
GiveThx takes significant steps to protect your personal information in an effort to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. Although we will exercise significant effort in protecting your personal information, no company can fully prevent security risks, and we cannot ensure or warrant the security of your Personal Information.

Parents and guardians can request to review any Personal Information collected about their child under 13 years of age, have this information deleted, and/or request that there be no further collection or use of their child’s Personal Information. We take the reasonable steps to verify the identity of anyone requesting information about a child and to ensure that the person is in fact the child’s parent or legal guardian.
No Student Accounts will receive any promotional emails. Those who create Teacher Accounts may receive promotional emails. If you wish to stop receiving promotional emails, you may do so by contacting us at email@example.com. You may also choose to unsubscribe from our emails by following the instructions in the bottom of the email.
The Children's Online Privacy and Protection Act ("COPPA") requires that online service providers obtain parental consent before they collect personally identifiable information online from children who are under 13. Therefore, we only collect Personal Information through the Services from a child under 13 where that Student's school, district, and/or Teacher has agreed (via the terms described in the following paragraph) to obtain parental consent for that child to use the Services and disclose Personal Information to us, for the use and benefit of the learning environment. If you are a Student under 13, please do not send any Personal Information about yourself to us if your school, district, and/or Teacher has not obtained this prior consent from your parent or guardian, and please do not send any Personal Information other than what we request from you in connection with the Services. If we learn we have collected Personal Information from a Student under 13 without parental consent being obtained by his or her school, district, and/or Teacher, or if we learn a Student under 13 has provided us Personal Information beyond what we request from him or her, we will delete that information as quickly as possible. If you believe that a Student under 13 may have provided us Personal Information in violation of this paragraph, please contact us at firstname.lastname@example.org
In addition, various federal and state laws, including the Family Educational Rights and Privacy Act (“FERPA”), protect the privacy of Student educational records and limit when a school may disclose a Student’s educational records. Teacher Users are solely responsible, under these Terms, for ensuring that their schools are compliant with all applicable laws and regulations, including, but not limited to, FERPA. Without limiting the generality of the foregoing, Teacher Users represent and warrant that for all Student Records disclosed by Teacher User (if any), such Teacher User has obtained, or his/her school has obtained, the appropriate consent from the parents of Student Users, or from the Students if such Students are 18 and older, as required under FERPA to make such disclosure and grant the following license. Teacher User, on behalf of his/her school, grants, or his/her school grants, to GiveThx a nonexclusive license to view, download, reproduce, modify, create derivative works of, distribute, and display such Student Records of a Student User solely for the purposes of (a) providing the Service to any Teacher Users of such Student User; (b) providing the Service to Student Users; and (c) to use de-identified and/or aggregated Student Records to improve the Service.
